I rushed my daughter to the emergency room of a nearby hospital using my motorcycle. I just want to know if I could be penalized for driving my motorcycle with my child on public roads.
Please be informed of the provisions of Sections 1, Rule I and 4, Rule II of Republic Act 0666, otherwise known as the “Children’s Safety on Motorcycles Act on 2015”, which read, viz:
“Section 1. Coverage
“These Rules shall cover all acts of driving/riding a two (2)-wheeled motorcycle with a child on board. Xxx
“Section 4. Exception
“Notwithstanding the prohibition provided in the preceding section, this Act shall not apply to cases where the child to be transported requires immediate attention.”
Clearly, the prohibition on driving one’s motorcycle with his/her child does not apply when the child to be transported requires immediate medical attention. In your situation, considering that you transported your daughter, who required immediate medical attention, with the use of a motorcycle, the above-mentioned exception shall apply.
