A hearing has been set for a patient at the Minnesota Sex Offender Treatment Program who is accused of punching another patient, leaving the man with a traumatic brain injury.

Rodick Dean Pouncy, 25, is due in Nicollet County Court on November 7 on a felony 1st-degree assault charge.  He was initially charged on September 25.

According to a criminal complaint, Pouncy and the 69-year-old resident got into an argument on July 5.  Court documents say Pouncy spit on the victim, who responded by punching Pouncy.

Pouncy then punched the victim in the face, according to the complaint.  The victim fell backward, struck his head on a wooden chair, then struck his again on the floor. The complaint says the victim bled from the head as he lay unconscious on his back for approximately 24 minutes.

The victim was transported to a local hospital where it was determined he was suffering from a brain hemorrhage.  He was then transported to another hospital via helicopter.

Court documents say the victim’s neurological conditions declined over the next five days, he had paralysis on his left side and he remained in intensive care.

Investigators say the victim’s medical records indicated his prognosis was poor and his limited life expectancy due to the traumatic brain injury would make him best fit for hospice or comfort care.

The complaint says the victim had garbled speech and was not able to have a meaningful conversation.

Pouncy will make his initial appearance in court at his upcoming hearing.
