WELCH — A preliminary hearing has been scheduled for a McDowell County man facing several charges including failing to register as a sex offender.

On Wednesday, Senior Trooper/CACU Investigator R. L. Jones with the assistance of Senior Trooper K. M. Saddler and Trooper L. A. Beggs of the West Virginia State Police Welch detachment and Probation Officer K. R. Williams concluded a month-long investigation at the residence of Scotty E. Hicks in reference to distribution of minors engaged in sexually explicit conduct, sex offender failure to register violations, and probation revocation.

Hicks is an active registered sex offender in McDowell County, according to a press release from the state police.

The new violations of the child pornography and failure to register violations were confirmed during a sex offender compliance check with probation.

Hicks was placed into custody without incident and charged with two counts of distribution/exhibit minors in sexually explicit conduct, seven counts of prohibiting child erotica, six counts of sex offender registration violations, and probation violations.

On Wednesday, a preliminary hearing for both investigations was scheduled in the McDowell County Magistrate’s Office. Both investigations were bound over to the McDowell County Circuit Court.

The probation revocation is currently pending and Scotty Hicks is currently incarcerated in the South Western Regional Jail (SWRJ).
