The Strafford County Attorney’s Office has filed a petition to designate a man as a certified sexual predator.Donald Levier was accused of assaulting a Somersworth woman on Sept. 5, 2021. In a civil bench trial Wednesday, the state sought to have Levier designated a certified sexual predator. The designation is meant to address those who are violent and dangerous. Usually, there is mental illness involved that treatment will not help, and the likelihood of reoffending is high.Being deemed a sexually violent predator would not result in Levier being charged with a crime, but it would involuntarily place him in a secure hospital setting for a set number of years.The first step in the process is a bench trial. The state called witnesses, including the accuser, who said she knew Levier and had never had an issue with him before the alleged assault.She said he came by her trailer early that morning. She asked for a cigarette and let him in, and they spoke for a while before, she said, things escalated.The woman said she kept screaming, “No means no,” while trying to fight him off for 45 minutes.The defense questioned the timeline and how the accuser had different answers about when Levier allegedly took his clothes off. The defense also called into question the woman’s reputation.A decision in the case has not been made.
