ORANGE COUNTY, NY — A registered sex offender from Kansas was accused of trying to get a minor to have sex.

Damian Williams, the United States Attorney for the Southern District of New York, said Thursday that Curtis Ellington, 33, of Junction City, Kansas, was charged with enticing a minor to engage in unlawful sexual activity and engaging in the offense while he was a registered sex offender.


Ellington was arrested in Kansas April 27 and detained pending his transfer to White Plains federal court.

He was arraigned and detained Thursday in White Plains.

Williams said Ellington, who is a convicted rapist, was not deterred by his previous involvement with the criminal justice system.

“This case underlines the urgent need for law enforcement to continue to its efforts to protect children from those who prey on them,” he said. “We will use every tool available to law enforcement to investigate and prosecute those alleged to have sexually exploited children.”

Prosecutors said Ellington was convicted Jan. 12, 2007, in Orange County Court of first-degree rape: intercourse with a person less than 11 years old. He was sentenced to seven years in prison.

As a result of the conviction, he was required to register as a sex offender.

On April 7, authorities said, Ellington slept at the Orange County home of a 15-year-old minor and, while there, engaged in sexual activity with the minor.

Previously, the victim and he engaged in numerous communications via Instagram in which Ellington, who used the Instagram screen name “Godson,” talked about his desire to have sex with the 15-year-old, according to law enforcement.

Authorities said the enticing a minor count carries a mandatory minimum sentence of 10 years in prison and a maximum sentence of life in prison. The second count carries a mandatory sentence of 10 years in prison, which must be imposed to run consecutive to whatever sentence is imposed for the first count.

Williams said that the investigation is ongoing and requests that anyone who may have information with respect to Ellington contacts the FBI tip line at 1-800-CALL-FBI.
