An Apollo man who is a registered sex offender is charged with sexually assaulting a woman in a portable restroom at Owen’s Grove Community Park.

Joshua Allen Gibbon, 22, of 400 block of Woodward Avenue was charged with felony counts of aggravated indecent assault, sexual assault and criminal use of a communications facility, along with a misdemeanor count of sexual assault in connection with an alleged incident on May 16.

While investigating the reported assault, a state trooper charged Gibbon with three additional felonies for allegedly failing to report a change in the location of his employment, which is required under the state Megan’s Law.

Gibbon was being held in the Armstrong County Jail in lieu of of a $25,000 cash bond, according to court records. He faces a preliminary hearing on July 6 before District Judge James Andring.

A woman told state police that she was at the park with a friend when she received a message on Snapchat from Gibbon, whom she has known since October 2022, asking her to come alone to the portable restroom near the swings and park building, the complaint said.

The woman told police Gibbon was inside the restroom and asked her to step inside, which she did.

She said Gibbon then locked the door and sexually assaulted her, according to his arrest papers.

The woman told investigators that she was able to get free from Gibbon and call 911. She was examined in the emergency room at Armstrong County Memorial Hospital, where a sexual assault kit was collected and turned over to police so it could be tested at the crime lab in Greensburg, the complaint said.

Police said they questioned Gibbon at his home on May 23 and he confessed to messaging the woman on social media to lure her into the park restroom and then sexually assaulting her.

While being questioned, Gibbon told a trooper that he was getting ready to go to work at the Wendy’s restaurant in Ross Township, where he was scheduled to work 30 hours that week, according to a separate criminal complaint filed against him.

Police learned that Gibbon was hired at the restaurant on March 29, but failed to notify state police. Gibbon previously reported that he was working for a landscaping company based in Apollo.

Gibbon also is accused of failing to show up for a required in-person reporting session at the Troop D station between May 19 and 28.

In October 2021 Apollo police charged Gibbon with six felonies after a woman who was staying at his house with her daughter after splitting up with her husband reported that he raped her.

Gibbon pleaded guilty in September to misdemeanor counts of indecent assault and unlawful restraint and was sentenced to two years of probation and ordered to register as a sex offender in connection with the incident, according to court records.

Gibbon is listed as a Tier II offender, which means he will remain on the Megan’s Law list for 25 years, according to state police.
