GENESEO – A Springwater man is facing a felony charge after allegedly failing to update information as a registered sex offender, reports the Livingston County Sheriff’s Office.

Alvin W. Chilson, 72, a level three New York State Registered Sex Offender, was charged June 27 by Sheriff’s Investigator Connor Sanford with felony failure to register and verify as a New York State Registered Sex Offender.

New York State recognizes three risk levels among sex offenders. A level three has a high risk of re-offense, according to the registry. A level two offender is considered to be at a medium risk of re-offense, while a level one has a low risk, according to the registry.

The investigation alleges that Chilson failed to provide an updated photograph as required by state corrections law, the Sheriff’s Office said.

New York State Corrections Law requires a level three sex offender to appear at the law enforcement agency having jurisdiction within 20 days of the first anniversary of the sex offender’s initial registration and every year thereafter during the period of registration for the purpose of providing a current photograph of themselves.

Chilson was turned over to Central Booking deputies at Livingston County Jail for arrest processing. The District Attorney’s Office requested that Chilson be held without bail due to having two previous felony convictions.

Chilson was later arraigned at Livingston County Centralized Arraignment Part at Livingston County Jail before Town of West Sparta Justice Sue Mahaney, who remanded Chilson to the custody of the Sheriff without bail.

The Livingston County Public Defender’s Office represented Chilson at his arraignment. The District Attorney’s Office did not appear.

Chilson had previously been convicted in October 1985 in Chemung County for first- and third-degree rape and incest. He had been arrested in December 1984, according to the state’s sex offender registry.

Chilson was sentenced to 12 to 25 years in state prison and released to the state Division of Parole in 2008, according to the state Department of Corrections and Community Supervision.
