Fred Rafferty was sentenced Friday to 7 years in state prison
WATERVLIET — Fred Rafferty, 57, of Watervliet was sentenced to 7 years in state prison, followed by 10 years of post-release supervision before the Hon. Andra Ackerman in Albany County Court on Friday, according the the Albany County District Attorney’s Office.
Rafferty pleaded guilty on May 30 to one count of attempted criminal sexual act in the first degree, a violent felony. The charge stems from an original indictment alleging that Rafferty engaged in sexual conduct with a three-year-old child on or about Feb. 7, 2022, in the area of 24th Street in Watervliet.
In addition to the sentence, three no-contact orders of protection were issued on behalf of the victims.
“I want to sentence you to more time than the range provides, but I cannot, and I understand that this offer was made to save the child victim from the trauma of having to testify at the trial, so I agreed,” Ackerman said. “I have received the letters from your family, but they do nothing before this court to reduce your sentence … the trauma that happened to this child is likely so much more than your plea acknowledges”
Assistant District Attorney Caroline Murray, the chief of the Special Victims Unit, and Trial Assistant Ashley Rizzo handled the prosecution of this case.
