POINSETT COUNTY, Ark. (KAIT) – Charges have been dropped against a Level 2 sex offender who volunteered at a local booster club without alerting law enforcement.
Second Judicial Circuit Court Judge Pam Honeycutt signed an order of nolle prosequi Tuesday in the case against Allyson Shea Smith, 35, of Manila.
In the request, Deputy Prosecuting Attorney Jimmy Turnbow cited a June 15 motion wherein Smith agreed to not volunteer with the East Poinsett County Booster Club in the future. Court documents also noted that aside from “this technical violation,” Smith has had no other infractions or violations of any kind regarding reporting and registration requirements under the Sex Offender Registration Act.
The investigation
Poinsett County Sheriff’s Detective Garrett Woods began investigating Smith last September after learning through social media that she had volunteered with the booster club.
“I knew that a Level 1 and Level 2 sex offender could legally volunteer with an elementary, secondary, or postsecondary school, as long as the local law enforcement agency having jurisdiction over the campus where they were volunteering was notified in person,” Woods stated in the affidavit.
Woods then contacted Lepanto Police Chief Mark Authement, who said neither he nor his department had been notified of Smith’s volunteering status.
After obtaining a copy of the Aug. 4, 2025, minutes of the EPC Booster Club meeting, which showed Smith had been added as a new member, Woods requested a warrant for her arrest for failing to comply with registration and reporting requirements.
Smith was arrested Sept. 10, 2025, for failing to register or comply with reporting requirements and was released from the Poinsett County Detention Center a little more than an hour later.
Smith’s background
Jonesboro police arrested Smith, who was a former school nurse at Rivercrest Junior High School, in 2018 on suspicion of sexual indecency with a child and fourth-degree sexual assault.
The following year, she pleaded guilty to the sexual assault charge and was sentenced to 36 months of probation. The sexual indecency charge was nolle prossed. The judge also ordered her to register as a sex offender.
The Arkansas Department of Public Safety identifies her as a Level 2 offender, meaning she is a “moderate risk” to reoffend.
