Ken Paxton is facing a Community Note after claiming that criticism of his handling of a child predator is wrong because the defendant “served 60 days.”
Paxton’s office initially reached a deal that would have allowed Adam Hoffman to receive credit for time served plus one additional day. That proposal was rejected by Judge Roy Sparkman, who questioned the wisdom of releasing Hoffman after only one day.

The deal was subsequently revised. Under Paxton’s new deal Hoffman was released after only serving 29 days, according to reporting cited by the Community Note. The original proposal from Paxton’s office would have resulted in an even shorter stay, making Paxton’s characterization of the case incomplete.
