The DGAO has stated that a chargesheet has been filed against KC under the Electronic Transactions Act, 2008. KC is accused of committing an offense under Section 47, Sub-section 1 of the Act.
In most cybercrime cases, the complainant’s name is not kept confidential, and standard procedure involves discussions with the victim. However, in this case, the Cyber Bureau submitted its report while withholding the complainant’s identity, and the case was filed accordingly.
Based on the complaint, KC was arrested by the police and kept in custody with extended detention. The KC family had filed a writ petition for habeas corpus, alleging illegal detention, and the Supreme Court ordered his release. The chargesheet states that KC used Facebook to spread hatred and animosity against the complainant, causing character assassination.
KC had posted a status on Facebook based on media reports claiming that Jayabir Deuba had purchased the five-star Hilton Hotel in Kathmandu. He later deleted the post.
