TALLAHASSEE, Fla. (WCTV) – Florida Attorney General James Uthmeier is officially calling for the impeachment of Judge Tiffany Baker-Carper.
The Tuesday afternoon announcement comes after Gov. Ron DeSantis signed Missy’s Law, which limits judges’ discretion for violent offenders awaiting sentencing.
Judge Baker-Carper presides over Daniel Spencer’s case. Spencer is accused of killing his stepdaughter, Missy Mogle, while out on bond for crimes related to meeting a minor for sex.
Uthmeier sent a letter to Florida House Speaker Daniel Perez, asking him to begin impeachment proceedings.
“This legislation vastly improves Florida criminal procedure to prevent judged from putting social justice over criminal justice,” Uthmeier wrote. “But, the people of Florida demand accountability for judges—like the judge responsible for letting Missy’s killer remain free—who grossly abuse their discretion by inexplicably refusing to take custody of convicted child sex predators, allowing them to continue preying on our children.”
The letter continues to detail the murder of Missy Mogle, a five-year-old girl from Tallahassee.
On April 15, 2025, Spencer was convicted of traveling to engage in unlawful sexual conduct with a child, according to the letter. Judge Baker-Carper allowed Spencer to remain on bond while sentencing for that case was pending.
Spencer is accused of killing Missy while out on bond.
“Judge Baker-Carper’s decision that allowed Spencer, a convicted child predator, to remain on bond is why Missy is dead today,” Uthmeier wrote. “This decision wasn’t just disgraceful, reckless, and unthinkable; it rises to the level of a ‘misdemeanor in office.’”
Florida law says a judge is liable to impeachment for a misdemeanor in office, and the speaker of the House of Representatives can appoint a committee to investigate charges against any officer subject to impeachment.
“Judge Baker-Carper’s actions brought disrepute upon the judiciary,” Uthmeier wrote. “But despite the obvious danger and warnings, Judge Baker-Carper let Spencer remain free, causing the untimely, violent murder of Missy.”
The Trial Court Administrator for the Second Judicial Court sent a comment to WCTV via email Tuesday evening about the call for Judge Baker-Carper’s impeachment.
“The Florida Constitution sets forth the impeachment process. The Constitution states that impeachment authority lies with the House of Representatives and the Senate. To preserve due process, it would be inappropriate for the Second Judicial Circuit to comment on any potential impeachment process, as such is the exclusive province of the Florida Legislature, just as it would be inappropriate to comment on the underlying criminal case, as it is still pending,” the statement says.
