Meta Platforms agreed to pay up to US$16.68 billion to settle claims from 29 US states over child data misuse and addictive platform design. The decision could affect advertisers, telecom operators, and platform-dependent businesses, which now face rising pressure to anticipate stricter child-safety standards ahead of formal regulation.  

Meta Platforms agreed to pay a maximum US$16.68 billion and overhaul core features of Facebook and Instagram to resolve claims by 29 US states that the company built its platforms to addict children, mishandled their personal data, and misled the public about the risks. The agreement ends a closely watched federal trial in Oakland, California.

For California Attorney General Rob Bonta, whose state stands to collect between US$1.5 billion and US$2.1 billion of the total, the settlement marks a shift toward enforceable design standards. The changes will “make social media less dangerous for our kids,” he says. Under the terms, Meta will impose a default two-hour daily limit for minors, block access between midnight and 6 a.m., mute notifications during school hours, and disable like counts and beauty filters for teenage accounts, all within months of approval.

Meta denied wrongdoing in agreeing to the terms. Before the trial began on Aug. 18, the company said California, Colorado, Kentucky, and New Jersey were seeking as much as US$1.4 trillion in penalties, while the states had signaled a figure closer to US$200 billion, court filings show.

The settlement caps an escalating string of legal defeats for the company. A New Mexico jury found Meta liable in March for algorithm-driven exposure of minors to sexual predators, ordering US$375 million in damages. A judge added a US$567 million public nuisance penalty in August. Separately, a Los Angeles jury found Meta and Google liable in March for an individual plaintiff’s depression and anxiety, ordering a combined US$6 million in damages; both companies plan to appeal. Meta, Snap, Alphabet’s YouTube, and ByteDance’s TikTok still face thousands of additional lawsuits in state and federal courts, including a trial that opened last month in Nashville over claims brought by Tennessee.

State consumer protection statutes, rather than federal content-liability shields, proved decisive in the US cases, a strategy that plaintiffs’ attorneys are likely to test elsewhere. Meta shares rose more than 2% in early trading following the announcement, as investors weighed the settlement against the certainty it removes from a trial that had exposed the company to open-ended damages.The California federal court still must approve the agreement before its terms take effect nationwide.

The case lands as Mexico works through its own reckoning with platform-enabled harm to minors, though under a different regulatory architecture. A Disrupting Harm study by UNICEF, INTERPOL, and ECPAT International found that 13% of internet users aged 12 to 17 in Mexico, about 1.6 million minors, experienced technology-facilitated sexual abuse or exploitation within a single year, with Meta-owned applications dominating reported incidents. According to the report, Facebook accounted for 52% of cases and WhatsApp for 46%. 

Mexican federal law currently exempts internet service providers from liability for user-posted child sexual abuse material, and telecom data-retention mandates do not extend to social media or messaging platforms, leaving authorities with limited tools to track illegal activity.
