Lewis Nash, of Chester Lane, Sutton Manor, had indicated guilty pleas to charges when he appeared at Liverpool, Knowsley and St Helens Magistrates’ Court on February 9 this year.

He was charged with causing a computer to perform a function with intent to secure unauthorised access to data between June 19 and June 23 last year.

He also faced two further charges of carrying out unauthorised acts, allegedly intended, or reckless as to whether they would, impair the operation of computer systems on June 21 and June 22.

The charges against 34-year-old Nash were brought under the Computer Misuse Act 1990.

A Merseyside Police spokeswoman previously said the charges related to business systems.

Magistrates committed to Liverpool Crown Court for sentence, and Nash was granted conditional bail.

His bail conditions included not to enter the Co-operative warehouse, on Elton Head Road, Lea Green.

Following an adjournment on March 9, the case was scheduled to be heard at the Crown Court today (Tuesday, March 31).

During this morning’s hearing, Nash’s defence barrister, Mr White asked for an adjournment.

He said his client had received a diagnosis of type two diabetes since the previous hearing and the court also heard Nash has struggled with his mental health.

Judge Recorder Sarah Griffin agreed to adjourn Nash’s sentencing for four weeks to enable consideration of any mental health treatment requirement.

The judge said: “I will adjourn the case for a mental health treatment requirement assessment to take place.

“I am adjourning sentencing to April 28.

“The reason for that, I understand you have had a diagnosis of type two diabetes and have significantly struggled with your mental health.”

Recorder Sarah Griffin told Nash that today’s adjournment did not give any indication of the sentence he would face and warned him that he could still face prison.

“All options are still open, including immediate custody.”

Nash was again granted conditional bail.
